Two-month period of preliminary investigation: anachronism requiring legislative review

The article examines the initial two-month period of preliminary investigation, established in Part 1 of Article 162 of the Criminal Procedure Code of the Russian Federation, granted to investigative bodies for the investigation of a criminal case. Based on the analysis of the norms of criminal procedure legislation, the opinions of scientists in the field of criminal procedure and provided statistical data, the author comes to the conclusion that this regulatory requirement, which implies the completion of the investigation of a criminal case within a two-month period, is imperfect, and it doesn’t fit with modern realities of practical activity and the need for its legislative revision taking into account the gravity of the crime committed.
