Financial risks of employers in reimbursement of child care allowance up to 1.5 years: some legal problems

In the conditions of legal uncertainty, the territorial bodies of the social insurance Fund of the Russian Federation violate the economic rights of policyholders, refusing to reimburse the costs of paying employees benefits for the care of a child under the age of 1.5 years, with reference to the lack of time for the employee to care for the child. The limits of part-time work required to care for a child in order to retain the right to receive a monthly allowance are not defined by the current legislation. The proposals prepared by the Minister of labor and social protection of the Russian Federation on the solution of the considered problem are investigated. The authors substantiate the need to make appropriate changes to the legislation to achieve a balance between the interests of employers-insurers, insured persons-employees, the insurer and the state.
