Formation and development of physical culture and sport as a fundamental function of the state: theoretical and legal aspect

The article analyzes the importance of physical culture and sports for the health of the nation, for creating in the ideology of society the need for adherence to a healthy lifestyle. The formation and development of the studied category, its complete and meaningful legislative regulation, active propaganda, financial support and support from the state are, in our opinion, the priority direction of its activities among the entire set of internal and external functions of the state. The proclamation and normative definition in the basic law of the state of the need to strengthen the health of the population through the development of physical culture and sports speaks of the relevance of the study of this direction from the standpoint of the fundamental function of the state. In the process of studying the regulatory legal framework theoretical and legal approaches within the framework of monographic studies, we came to the conclusion that it is advisable to single out the formation and development of physical culture and sports as one of the basic directions of state activity. At the same time, the branch of sports law is of certain interest within the framework of the above-mentioned function of the state. Despite the highly specialized nature and content of the emerging branch of law, as a rule, containing the area of regulation of civil law relations in the field of sports, the authors believe that this branch, of course, is an integral structural element of the development of physical culture and sports. Currently, it is necessary to expand the boundaries of the content of the field of sports law and focus on the promotion and mass introduction of physical culture into the life of society, the formation of physical fitness and, as a consequence, the improvement of the quality and extension of life of the population, which determines the primary function and the task of the state.
