Formation of undercover investigative actions in the criminal procedure legislation of Russia

Introduction: the given article deals with the historical stages of the formation of such a legal phenomenon as “undercover investigative actions”. The author determines the meaning of the given concept states the points of view of procedural scientists as well as proves the necessity to apply the mentioned actions based on the peculiarities of their appearing. Materials and methods: the legal framework of the given research is formed by the criminal procedure legislation of Russia (data taken from the legislation of the Russian Empire and up to the acting legislation), scientific works of procedural scientists as well as other regulatory legal acts related to the issues under examination. Having analyzed all this facts the author concluded the results to be formulated in the given article. The methodological basis of the research is scientific works in the field of the criminal proceedings on the given problem. The main research method used in the given work is a general dialectical method of scientific knowledge which is said to be universal. Also the author used methods of logical induction, a deduction, cognitive methods as well as methods of analysis, a comparison, a description and a method of generalization. The results of the study: the stages of formation of undercover investigative actions were identified; the concept of “undercover investigative actions” was examined as well as the content and procedure for their production depending on the stage of their formation and the specifics of statutory regulation in the criminal procedure legislation. The results of the study: due to a significant increase in the population’s need to apply electronic devices, technical equipment of the criminal environment, undercover investigative actions are becoming an important factor in the activity of a criminal investigator.
