Characteristics of an outsourcing agreement

The article analyzes the features of an outsourcing agreement. It is concluded that it is consensual in nature, due to the need for the parties to determine the order of interaction before the direct transfer of the function to the outsourcer. The beginning of its servicing may be preceded by the creation by the parties of the agreement of the necessary conditions for this, the provision of which is part of the obligation. The outsourcing agreement refers to reimbursable obligations, is bilateral, and has a fiduciary nature. The agreement is specific, since the method of servicing the function must meet the needs of the customer. The parties can choose an outsourcing model, on which certain characteristics of this agreement depend.
