The institutional basis of administrative and legal support of transport security (federal level)

Introduction: the legal framework for ensuring security, defining the circle ofparticipants in the administrative and legal relations in transport security, does not establish an exhaustive list of federal executive authorities endowed with the appropriate competence, does not build them into a system and does not define a coordinator of joint activities. That is why the issue of forming the institutional basis of administrative and legal support of transport security remains relevant and is of particular scientific interest. Purpose: to analyze the competence of the federal executive authorities using administrative and legal means and methods in ensuring the safety of the transport complex, to develop proposals for the systematization of the subjects. Methods: the study is conducted using the general scientific and specific scientific (logical-legal, comparative-legal) methods of cognition. Results: the author proposes a system of federal executive authorities that provide administrative and legal support of transport security, the system is structured depending on the industry and the sphere of public administration, and four groups of the subjects are identified: general competence management bodies, security management bodies, management bodies in the transport industry and other management bodies. Conclusions: ensuring transport security at the federal level is assigned to a significant number of executive authorities, which form the institutional basis of administrative and legal support of transport security. The multiplicityof the management subjects requires the coordination of joint activities. It is proposed to amend Article 4 of Federal Law No. 16-FZ of 09.02.2007 “On Transport Security”.
