Institute of the special opinion of the judge of the constitutional court

This article analyzes the institution of a special opinion of a judge of the Constitutional Court, its importance, potential and purpose. This issue is relevant in connection with relatively new amendments to the legislation limiting the possibility of publishing such an opinion. The analysis of the opinions of legal scholars on this issue, both in favor of restrictions in the publication and against it, is carried out. Based on the data, we will make our own opinion on this issue from the point of view of expediency.
