The institution of exemption from responsibility for willful false testimony: inconsistency of the goal and the legal result

The institution of exemption of a witness or victim from criminal responsibility for willful false testimony (Comment to Article 307 of the Criminal Code of the Russian Federation) is analyzed in the article. Willful false testimony, especially given by prior agreement, is used to falsify the circumstances of the case and manipulate the investigation, which requires supplementing the comment, taking into account the pressure and severe consequences for the protection of constitutional rights. It is proposed to exclude exemption in mentioned cases.
