Historical foundations of the formation and development of the principle of freedom of contract

The author conducted a study of the historical stages of the formation of the principle of freedom of contract from Roman law to the modern interpretation in the legislation of the Russian Federation. In different time periods, this principle was subject to consideration by the greatest jurists, its content, concept and application procedure were determined. The examples of normative legal acts of different historical epochs, in which the principle of freedom of contract was used, are given. A long period of Soviet law is analyzed, in which this principle was not subject to active use and was returned only to the Russian legal system.
