Environmental compliance as part of corporate policy

In Russia, more and more attention is paid to the development and implementation of the compliance. The most widespread in public joint-stock companies was the antitrust compliance. However, according to experts, the introduction of an environmental compliance can increase the investment attractiveness of the company. In this connection, the question arises of the legal regulation of the compliance, and clarification of the competence of the corporate governance bodies. In contrast to economic, legal scientific literature does not pay the necessary attention to the indicated problems. This work opens a study on the environmental compliance as a law institute. The environmental compliance is part of a corporate policy based at the state policy. However, the lack of an effective mechanism for implementing environmental policies does not allow it to be implemented everywhere. Also, differences in the legislative regulation of the competence of the Corporation's management bodies to determine the company's policy and its implementation are negative. Thus, in a joint stock company or in a limited liability company, these powers can be assigned to both the general meeting of participants and the board of directors (supervisory board). However, in the peasant (farm) holdings, this issue is completely unresolved. Other factors that hinder the development of the ecological compliance include: the voluntary application of the ecological compliance, the lack of legislative incentives, significant financial costs for the formation of the compliance system.
