The accused is a party to criminal proceedings who has a personal interest in the outcome of the preliminary investigation. His rights and legitimate interests in criminal proceedings are subject to severe restrictions related to the preventive measures and the subsequent criminal sentencing. In recent times, the Russian procedural scientists indicate the problems of the institution of the indictment that require a scientific solution. The paper deals with the issues that take place within a set of procedures related to the indictment in pre-trial criminal proceedings. Based on the analysis of the views of scientists and empirical material, the author justifies the need to exclude the formal approaches of the subject of proof (investigator) to bringing charges and reveals the significance of this preliminary investigation stage for the prosecution, the defense and criminal proceedings as a whole.
