On the issue of the need to modernize the composition of article 305 of the Criminal Code of the Russian Federation "The imposition of a knowingly unlawful sentence, court decision or other judicial act"

This article discusses the problem of the need to modernize Article 305 of the Criminal Code of the Russian Federation. Having analyzed the criminal legislation, special literature and judicial statistics, we identified the main shortcomings of the legislative regulation of the specified corpus delicti and made an unambiguous conclusion that the article should be amended. In addition, we have proposed a model that takes into account and corrects all the problems of Article 305 of the Criminal Code of the Russian Federation. In our opinion, this will help to resolve the difficulties encountered by law enforcement officers related to the imperfection of the current version of the analyzed norm.
