On the issue of prospects for optimizing the mechanism of criminal law protection of elements of the military memorial heritage

The article is devoted to the optimization of criminal law protection of military memorial heritage as a community of historically valuable objects (monuments, steles, obelisks, other memorial structures), owing to which the objectification of historical truth is possible. It is noted that the existing norm of the criminal law (Art. 2434 of the Criminal Code) has the potential to deepen differentiation and establish responsibility for the destruction, damage to military memorial structures by arson, explosion or other socially dangerous means. Attention is drawn to the need to apply restorative (recreative) procedures as actions to restore military memorial structures that have been subjected to destructive effects as a result of crimes to their original constructive state.
