On the question of the comparative characteristics of the labor and civil law contract

The article examines in comparison the legal nature of an employment contract and a civil contract. The characteristic features inherent in the employment contract were identified, the problem in distinguishing the emergence of labor and civil law relations was highlighted. The article defines the essential criteria for distinguishing an employment contract from a civil contract. The research is based on the analysis of Russian legislation, Resolutions of the Plenum of the Supreme Court of the Russian Federation, and other materials of judicial practice.
