To the issue on the structure of legal thinking

The article deals with the analysis of the problem of the concept of legal thinking, comparing it with the concept of thinking in a logical sense, as well as other types of professional thinking. The problems of the characteristics and structure of legal thinking are investigated on the basis of the analysis of various points of view expressed in the scientific literature; the author's definition of “legal thinking” is formulated. The various aspects of legal thinking are considered: logical, socio-psychological, pragmatic and others. The author comes to the conclusion that the criteria for the identification of legal thinking as an independent professional thinking should be the legal nature of all its elements: the object to which it is directed, instruments of mental activity in the form of previously established concepts and mental activity.
