On the issue of the essence of the institution of exemption from legal liability

The article raises the issue of exemption from legal liability, in particular from measures of state influence provided for by the criminal legislation of the Russian Federation. Special attention is paid to the difference between the institution of exemption from liability and the institution of exemption from punishment. A special place in the article is occupied by the analysis of Article 78.1 of the Criminal Code of the Russian Federation, introduced on 03/23/2024 by Federal Law N 64-FL. Conclusions are drawn about the compliance of such grounds for exemption from liability with the general objectives of criminal law.
