On the issue of prohibition in public service in receiving a gift

This article discusses topical issues of regulatory regulation of the issue of receiving gifts from individuals and legal entities by civil servants. The article analyzes the terms "gift", "bribe", their relationship from the point of view of legislation, analyzes various situations, gives a legal assessment of the actions of participants interconnected in connection with the receipt of gifts by public servants. The main idea is the statement that when assessing the status of a thing transferred to a civil servant, the predominant role is played by the possibility on the part of a civil servant to provide certain preferences in relation to the donor during the performance of his official duties. The study is based on the analysis of legislation, instructional materials on the issue under study, developed by federal ministries and departments within their competence.
