Revisiting anti-legal impact of social partners on the labour relations

The article is considered main manifestations of anti-legal impact of social partners on labour relations in the process of lawmaking and law enforcement. It is offered a number of ways to prevent such exposure by making appropriate changes in current labour legislation. It is alleged that the solution could be the implementation of the provisions of the court practice on the prohibition of the abuse of the social partners right, in particular, Article 24th of the Labour Code of the Russian Federation, as the principle of the inadmissibility of abuse of the right by social partners. It is concluded that the guarantee of anti-legal impact is served as control (supervision) of the state represented by relevant authorities.
