Performativity in the context of the juridical discourse

The article attempts to discuss philosophical and juridical aspects of performativity traditionally regarded as a linguistic category in the context of the theory of speech acts. Authors highlight particular language material initially employed by J.L. Austin in his research on performativity and performatory utterances. They also presume that there could be interaction and mutual influence of ideas proposed and developed by J.L. Austin and the founder of analytical philosophy of law G.L.A. Hart. They conclude by focusing on a possibility of using philosophical and juridical interpretation of performativity as a useful category for the research on speech and written texts of legal discourse to explore, inter alia, challenges of juridical linguistics and legal translation studies.
