Conceptual Basis for Building Positive Administrative Responsibility

Introduction. The objective is to formulate the basis for the concept of positive administrative responsibility with regard to the multiple factors that influence the psychological aspect of responsibility related to the individual’s personality qualities, such as the sense of duty, conscience, awareness of responsibility towards society and the state. Materials and Methods. The methods employed involve the analysis and synthesis of normative legal acts, scientific literature, police officers’ experience in law enforcement, modeling of practical situations. The methodological basis of the study was a system approach, representing the concept of positive administrative responsibility as a system that consists of several interdependent components. This approach takes into account all the factors that influence the development of a sense of responsibility in subjects of law. Results and Discussion. Modern Russian legislation shows a tendency to the increase in number of administrative punishable acts and strengthening of sanctions. Despite this, the practice proves insufficient effectiveness of repressive measures, as offenders often continue to violate laws. To overcome this situation, it is necessary to work comprehensively on the formation of positive responsibility, including educational and awarenessraising activities aimed at increasing the level of legal literacy and conscientious observance of laws. Conclusions. The effective functioning of the system of positive administrative responsibility requires joint efforts of the legislature, law enforcement agencies, judicial authorities and educational institutions.
