The conceptual foundations of the formation of the legal framework of the innovative system of local government and self-government in the Republic of Kazakhstan

This article discusses the specifics of the legal framework for the organization and activities of local governments in the Republic of Kazakhstan. The relevance of the research topic is caused by the need to form an effective system of local self-government in Kazakhstan, which does not exist in the country to date. The purpose of the study is to consider the issues and problems of constitutional and legal regulation of local self-government (LSG) in Kazakhstan, to search for innovations in the formation of a real and effective system of local self-government bodies. This study analyzes the genesis of the local government system in Kazakhstan, identifies the main problems and provides appropriate recommendations for their solution. The goals and objectives of the Project "Formation of an effective system of local self-government in Kazakhstan: state, problems, solutions, innovations" are considered, which is an innovative and socially necessary scientific research that meets modern realities and challenges of the time. Attention is drawn to the complete absence of norms on executive bodies of local self-government in the Constitution and laws. Conclusions have been drawn that, in modern conditions, the main and initial issue for the system of local self-government in Kazakhstan is the legal status of representative and executive bodies of local self-government, as well as the problems of their financing. It is argued that there are no real executive bodies in the local government system in the country. It is proposed to introduce a legal provision of a conceptual nature into the current legislation stating that, in accordance with the administrative-territorial structure of the Republic of Kazakhstan, representative and executive bodies of local self-government are created by members of the local community of a locality (village, settlement, city).
