Confiscation: restriction of constitutional property rights or a special mechanism for protecting public interest?

The paper presents an analysis of the essence of the institution of confiscation from the standpoint of respect for constitutional rights and freedoms, the features of its application are determined. The formed judicial practice, legal positions of the Constitutional Court of the Russian Federation on the issue of restriction of the constitutional right of property are investigated. The constitutional and legal limits of confiscation and the peculiarities of their application in practice are revealed.
