Constitutionalization of justice in the Russian Federation: regulatory framework and practical implementation

The issues of constitutionalization of justice in the Russian Federation are increasingly becoming the subject of scientific discussions and articles. In the framework of this study, the author identifies the main directions of the constitutionalization of justice in the Russian Federation since the entry into force of the provisions of the Constitution of the Russian Federation in 1993. The paper concludes that, despite the significant amount of legislative consolidation of the constitutional foundations of justice, in law enforcement practice, the direct effect of the Constitution and constitutional legislation has not become the norm, which significantly reduces the authority of the judiciary and the credibility of citizens and their associations. The author sees the overcoming of the current situation in the formation of a systemic and sustainable practice of administering justice in various forms of legal proceedings based on the “extended” application of the norms of the Constitution of the Russian Federation and decisions of the Constitutional Court of the Russian Federation.
