The current state of law enforcement activity allows us to ascertain the existence of an unresolved problem, related to the actualization of the right for liberty and security of person in the criminal process. The author is of the opinion that one of the main reasons for this lays in the lack of a uniform approach to the interpretation of the essence of right, which is, first of all, a constitutional definition. That is why, the study of constitutional and legal understanding of the right for liberty and security of person is actual.
