Convalidation of nothing transactions

The relevance of the study of this topic is due to the fact that the convalidation of void transactions is still a problematic field of Russian legislation. The aim of the work is to analyze the features of the process of convalidation of void transactions at the present stage of development of Russian legislation. The study made it possible to identify the most significant problems in the qualification of void transactions, the main of which are: the problem of differentiating invalid transactions into void and voidable, the absence of rules regarding the qualification of void transactions in the Civil Code of the Russian Federation, extremely contradictory judicial practice on the qualification of void transactions. The main assumptions for optimizing the area under consideration are: protection of third parties from abuse of the right to conclude other parties to a transaction that has been declared and void; supplementing the Civil Code of the Russian Federation with relevant articles, legislative expansion of the methods for concluding void transactions.
