Criminalistic prevention of the production and distribution of child pornography

The article considers theoretical and practical aspects of criminalistic prevention of crimes related to the production and distribution of pornographic materials involving minors. The concept of criminalistic prevention is clarified, and the determinants and main directions for the implementation of preventive measures are identified in the context of the group of crimes under consideration. Based on an analysis of current legislation, investigative and judicial practice, and scientific approaches, the key stages of criminalistic prevention are identified: from identifying the causes and conditions leading to the crimes to the implementation of specific organizational and tactical measures. Special attention is paid to the procedural form of exercising the investigator’s preventive powers, including by making reasoned submissions in accordance with Part 2 of Article 158 of the Criminal Procedure Code of the Russian Federation, as well as interaction with civil society institutions, educational organizations, the media, providers and law enforcement agencies of foreign states. The article substantiates the need to move from declarative prevention to a multilevel preventive system of measures proposed by the authors, implemented by the investigator (or other persons on his behalf) at all stages of the investigation and capable of effectively responding to new challenges related to digital technologies, social networks and the high latency of crimes in this category.
