Criteria for the Degree of Correction of the Imprisoned Convicts: Setting the Problem

Introduction. The modern penal-executive policy of our state, the organization of the correctional process in the context of improving the penitentiary legislation demand new approaches to the correction of convicts. This area is especially relevant in the framework of the implementation of the Concept for the development of the penitentiary system of the Russian Federation for the period up to 2030. In this area of public relations, an independent niche is occupied by psychological criteria for the degree of correction of convicts, which make it possible to determine the reliability of the correction process. The goal is to reveal and make a comprehensive analysis of the psychological criteria for the degree of correction of those sentenced to deprivation of liberty. Results and Discussion. The penal-executive legislation does not provide for the degree of correction of convicts sentenced to deprivation of liberty, the criteria for their correction fragmentarily reflected in the framework of the implementation of some of the legitimate interests of convicts. It is considered necessary to provide at the legislative level the degree and criteria for the correction of convicts, including psychological ones, and establish the dependence of achieving the degree and the criterion of correction on arising of certain legal consequences. The concepts of "correction" and "correction of convicts" are studied, the authors’ version of understanding this process is formed. Groups of criteria for assessing the degree of correction of convicts are proposed, which must be taken into account when determining a particular degree of correction. A scoring system has been developed to assess the degree of correction of convicts. The authors prove it necessary to consolidate in legislation dependence of convicts’ achieving a certain degree of correction upon arising of certain legal consequences (narrowing or extension of legal restraints). Conclusions. The article contains the authors’ classification of criteria for the degree of correction of convicts, including a group of psychological criteria.
