The idea of human rights protection has gone a long path through history - from ancient times in its initial form through the bourgeois period in which the idea was completely developed, till the twentieth century, when it has experienced huge expansion and internalisation. Each country must undertake everything in its power to build such a legal system that will allow the exercise and proper mechanisms to protect human rights. An interesting topic of modern society is a healthy environment and ecological crisis, and in the face of such contemplation one can draw to the surface the issue of state's attitude towards the environment and the right of the individual to live in a healthy environment. On the other hand, societies differ among themselves according to development of civil consciousness, awareness and familiarity of their citizens with the fact that the environment is legally protected and the human rights which go along with such affirmative relation to the environment thereof (civil, constitutional and criminal). This paper demonstrates the basic documents which guarantee human rights, among them the right to a healthy environment, review the current situation in this field of our economic and legal system, and environmental responsibility of society towards the environment and economic coordinates, as well as elements that clearly indicate that there is a serious crisis of environmental rights and the environment in general.
