The range of subjects that are controlling persons of the debtor

The article examines the legal grounds and criteria for determining the status of a controlling debtor in bankruptcy proceedings. The author analyzes the presumptions of control established by law and judicial practice of their application. Special attention is paid to the issues of actual control, nominal management and liability of beneficiaries. Controversial cases of bringing to subsidiary liability are considered.
