Mediation as an alternative way of settlement of individual labour disputes: problems and prospects of development

The article deals with questions of mediation in the process of consideration and settlement of labour disputes. The author considers the role of mediators, requirements imposed on them, analyses their competence. It is concluded that, firstly, it is important to introduce mediation as an obligatory stage of settlement of individual labour disagreements and disputes; secondly, it is advisable to review the requirements imposed on mediators, in particular, criminal background check; thirdly, it is necessary to introduce the requirement of higher legal education of mediators; fourthly, the author considers the possibility of inclusion of consideration and settlement of collective labour disputes in the competence of a mediator.
