Problems of ensuring legality in public administration: critical analysis and modern approaches

Introduction. In the Russian Federation, as a state based on rule of law, laws in general and, in particular, administrative law should provide new opportunities for the legal regulation of state functions. It is necessary to consider and reflect modern trends in public administration methods and ways in order to improve them, develop interaction between the government and society. The cultural functions of the State, cultural rights, and freedoms are separate aspects of social life that are the object of government support. Recognition of dual nature (external and internal) of cultural functions is fundamental for improving mechanisms for their implementation, where new means and methods for fulfilling external and internal state cultural tasks should be focused. The article identifies features inherent in the administrative and legal mechanism for implementing the cultural functions of government, components of this system in relation to culture, and formulates proposals to improve it. Materials and Мethods. The research materials included scientific works by Russian scientists on the topic of the study, as well as the regulatory legal framework of the Russian Federation. The methodological foundation of the study consisted of the dialectical approach, analysis of historical and legal sources, and other methods. The Results of the Study made it possible to reveal the essence of the mechanism of administrative and legal support for the cultural function of the state, which is a system aimed at streamlining legal relations in the field of culture, regulating them and ensuring the interaction of state bodies with other subjects of legal relations. Findings and Conclusions. The analysis has led to the conclusion that, in order to improve the efficiency of the cultural functions of the state, it is necessary to minimize the administrative impact on cultural institutions, creating conditions for their autonomous development within the legal framework. The state must focus on supporting and promoting the cultural sector, avoiding excessive management interference.
