This article examines the mechanism of formation of judicial discretion with the consent of the accused with the charge brought against him, the history of the emergence of this institution and its regulation in the Criminal Procedure Code of the Russian Federation, the legal limits of the judge's powers to exercise discretion in a particular criminal case, as well as what caused the introduction of simplified judicial procedures into criminal procedure legislation.
