Бесплатный доступ

The institution of exemption from criminal liability and the practice of terminating criminal cases are studied from the standpoint of the presence in the relevant court decisions of conclusions about the guilt of a person, and their relationship with the presumption of innocence. The work is based on the analysis of the current criminal law and criminal procedure rules governing the institution of exemption from criminal liability, and judicial practice. Based on the analysis, law enforcement clarifications are offered.
