World experience in regulation of countering unfair competition

The modern global and national economy functions primarily on the principles of a market model, in which competition becomes an integral part of economic activity. This article is devoted to the analysis of legal mechanisms for regulating competition and countering unfair competition in a modern market economy. The author examines the prerequisites for the emergence of unfair competitive practices, their negative impact on consumers, business entities and state interests. Special attention is paid to the role of the state in shaping the regulatory framework that ensures a balance between freedom of entrepreneurship and the need to protect economic justice. A comparative legal analysis of approaches to regulating competition in various jurisdictions has been carried out, including three groups of states identified according to the degree of institutionalization of norms in the field of combating unfair competition. The necessity of active state participation and international legal cooperation in order to increase the effectiveness of the national antimonopoly legislation of the Russian Federation is substantiated.
