The Motivational Component of Governing Constitutional Norms

The article examines the problems of the legal content of governing constitutional norms, which are a type of incentive norms, along with prohibitive and obligatory ones. The motivating component of this content is investigated. Attention is paid to stimulating factors that make it possible to strengthen the motivation of governing norms. The disclosure of the content of the stated topic was facilitated by the dialectical method of cognition, as well as special methods: formal legal, comparative legal, and legal analysis. Approaches to understanding the governing constitutional norms are presented, their motivational component is identified, and the role of stimulating factors contributing to the implementation of the legal norm is shown. Some legal documents are evaluated from the standpoint of their motivating influence on legal relations. The motivating component is inherent in all governing constitutional norms. It is reinforced not only by the use of incentive tools, but also by itself has an impact on law-making and law enforcement practice.
