Directions for improving legislative regulation in the Republic of Belarus rights of citizens and legal entities to appeal to state bodies

In the article, the author conducted a study of the regulatory legal acts of the Republic of Belarus regulating the procedure for filing applications by citizens and legal entities to state bodies and their consideration by officials of these bodies. A comparative analysis of the provisions of the Belarusian legislation with the legal norms of some foreign countries in terms of exercising the right to appeal is carried out. The modern scientific points of view of scientists on constitutional, administrative law, the theory of law on the essential aspects of the right to defense by appealing to state bodies were subjected to critical reflection. To obtain a comprehensive understanding and the reliability of the formulated conclusions, it was also required to familiarize with the practice of government bodies with appeals from citizens and legal entities. The purpose of this study is to identify problems of the theoretical and applied nature of the institution of citizens' appeals and to develop sound proposals for their elimination. In the article, the author formulated the definition of the concept of "appeal", clarified the classification of citizens' and legal appeals in the context of the content of the norms of various branches of law, highlighted the peculiarities of the procedure for considering certain types of appeals, noted the gap nature of a number of legal norms regulating the procedure for exercising the right to protect the legitimate interests of non-public entities by appeals to government agencies. On the basis of the study, specific proposals were formulated for making changes and additions to the current legislation of the Republic of Belarus, including taking into account modern global trends and the practice of developing electronic communications.
