Viplation of the principle of legal separation by the norms of article of the Land Code of Russian Federation on the terms, methods of submission and form of intent to participate in the auction legislation

The authors analyzed the provisions of Article 39.18 of the Land Code of the Russian Federation and law enforcement practice. It is concluded that there is a lack of uniformity in its interpretation in the process of law enforcement due to insufficient clarity of content, as well as an imbalance in the balance of private and public interests. It is noted that this carries a significant risk of invalidating land transactions already concluded without bidding. Proposals have been formulated to change the specified norm of land law with regard to the calculation of the deadlines and methods for filing statements of intent to participate in the auction and the form of such statements.
