Scientific polemics is constructive when it is not getting “near-scientific” (in connection with the article by M. K. Sviridov "Industry affiliation of the norms governing judicial activity in the execution of the sentence")

On the basis of the established doctrinal ideas about the essence of judicial activity related to the execution of a sentence, the author makes an attempt to give new, additional arguments for considering this type of judicial activity as a special procedure in the system of criminal procedure. M. K. Sviridov's opinion is examined. M. K. Sviridov interprets the execution of the sentence as the final stage of criminal proceedings, shows its contradictions and shortcomings. An independent scientific direction in the research of judicial activity on the execution of the sentence is indicated, the supporters of which in the content of the stage of the execution of the sentence include exclusively the activity of turning the sentence to execution.
