"Not installed" sanitary and protective zones, or about legal bases and consequences of inclusion in the rules of land use and development of orientational and designated health protective zones

The author draws attention to the fact that the approximate size of the sanitary protection zone (SPZ) of industrial production and facilities according to the Sanitary and epidemiological rules and regulations 2.2.1 / 2.1.1.1200-03 of 2007 should have been developed sequentially: first, the calculated (preliminary), then the final. He gives examples of court decisions on disputes arising in connection with violations of the procedure for establishing the SPZ. It comes to the conclusion that the violation of the previously existing rules for establishing such zones leads to a violation of the rights of owners and tenants of land plots, hampers the development of human settlements and jeopardizes the fulfillment of state plans to provide housing for Russian citizens.
