This article discusses the problem associated with performing the immunity of the debtor during foreclosure on the property and as a consequence damages, which undergo creditors, including the state. Lenders, faced with the impossibility of collection of amounts owed in connection with the absence of a debtor’s income and property. It is proposed to improve the manner and the procedure for repossession of premises if it is established that it is not habitable and the debtor does not take any measures to bring the premises into condition.
