Some problems of legal regulation of bank secrecy

Certain problems of legal regulation of banking secrecy are considered, in particular, it is shown that there is a contradiction between the general rules of competition law that give FAS Russia the right to demand disclosure of banking secrets, as well as banking rules, which do not provide for the provision of confidential information to this authority. A reasonable resolution of the contradiction would be to establish the advantage of a special rule related to banking. There is uncertainty in the use of information related to bank secrecy as evidence in a civil dispute, which can be obtained by the court in order to assist the parties to the case. Such a possibility seems reasonable in the absence of another way to prove the circumstances referred to by the party.
