Some problems of qualification of violent embezzlement

Бесплатный доступ

The article examines some of the problems of qualifying violent theft arising from encroachment on an additional object, which is a person. It is shown that the objective side of violent theft in some cases can cover other elements of crime, including leaving in danger and kidnapping. The conclusion is made that there is no need for additional qualification of violent thefts, albeit committed in a similar way, but pursuing exclusively goals related to theft, since violence against an individual itself is covered by its objective side. The qualification of violent embezzlement as a set of crimes becomes possible when the actions of the perpetrator associated with an encroachment on a person are aimed at achieving additional goals that are not directly related to violent embezzlement.
