Some issues of improving the legal norms of the Russian criminal legislation on crimes against life and health (experience of comparative analysis)

The article presents a comparative analysis of a number of Articles of the Criminal Code of the Russian Federation and the Criminal Code of the Republic of Belarus, providing for liability for crimes against life and health, which allowed to identify some problems of designing the norms of the domestic Criminal Law and to assess the possibility of using foreign experience in solving these problems. Using the positive experience of the criminal legislation of the Republic of Belarus, the authors proposed and justified a new version of Article 106 of the Criminal Code of RF which excludes the uncertainty of interpretation of the elements of crime. According to the authors' opinions, the failure of the captain of the ship to help those in distress is a special type of crime such as leaving in danger, so it seems appropriate to Article 270 of the Criminal Code of RF «failure of the captain of the ship to help those in distress» to exclude from the Chapter «Crimes against traffic safety and operation of transport», and to supplement the Chapter «Crimes against life and health» with Article 125.1 with the title and content similar to Article 270 of the Criminal Code.
