German legal positivism

The study investigates the interpretations of legal positivism in the regional aspect based on the assessment of one-of-a-kind legal views of several German legal scholars, who are traditionally regarded as the supporters of legal positivism. The analysis of the specific nature of German legal positivism is based on the opinions of legal scientists (A. Kaufmann and K. Olivecrona) and the works by K. Bergbohm, E.R. Bierling, and A. Merkel as the leading representatives of this doctrine. German legal positivism is characterized by the wide use of the techniques and methods of sociology, psychology, modifications of several signs of natural legal doctrine, sociocultural knowledge in general when justifying the law. One more feature is that the key topics of German legal positivists have been further discussed within the framework of neo-positivism.
