Atypical Situations in the Law Enforcement Process: Issues of Legal Technique

Introduction: atypical situations in law enforcement are currently a common occurrence, with both objective and subjective causes. These causes are connected to the specific nature of normativity or factuality, which influences how particular situations are resolved in the context of the dynamic development of legal relations. At the same time, these situations have not been fully explored in legal doctrine, receiving fragmented and controversial coverage, which also applies to their technical and legal aspects. Given the complex and multidimensional character of modern law enforcement transformation, it appears that legal technique should be focused on filling the gaps in this area. Methods: the methodological basis of the study is represented by a set of methods characteristic of modern jurisprudence: general scientific, dialectical, formal legal, comparative legal, logical-syntactic, semantic, forecasting, analysis, and synthesis. Results: the study identified the essence of atypical law enforcement, characterized its causes and conditions, and analyzed the technical and legal issues involved in relevant law enforcement situations. The author emphasizes the current challenges of potential quantitative growth, as well as the qualitative uniqueness of atypical law enforcement situations, due to factors such as the revision of classical scientific approaches, the development of technological progress, the increasing role of atypical law enforcement entities, legal experimentation, and the expansion of alternative dispute resolution practices. Based on the results of the study, the author formulates conclusions containing technical and legal recommendations for law enforcement practitioners regarding atypical situations. The author emphasizes the importance of ensuring conformity (compatibility) between the techniques and technologies of “classical” and atypical law enforcement, stating that law enforcement discretion remains a decisive factor.
