On the expediency of carrying out investigative actions suggesting obtaining testimony at night time in urgent cases

The inexpediency of carrying out investigative actions suggesting obtaining testimony at night time in urgent cases is proved in the article, taking into account the psycho-physiological characteristics and daily cyclicality of human functioning. It is proposed to supplement part 3 of Article 164 of the Criminal Procedure Code of the Russian Federation with a provision prohibiting interrogations, face-to-face questioning, presentation for identification and verification of testimony at the crime scene at night time.
