On international experience in criminalization of the organization of illegal migration

The article briefly outlines the main provisions of the international criminal law regulation of illegal migration. The author points out and analyzes both objective and subjective reasons for migration, identifying a number of factors that influence and determine certain trends in changes in the causes of both legal and illegal migration, and notes the need to regulate the fight against illegal migration in international legal acts. An analysis of the content of certain main international acts aimed at combating illegal migration and the organization of illegal migration is made. The opinion on the need to combine in practical activities simultaneously two directions in countering the organization of illegal migration is argued: the prosecution of persons committing crimes and the creation of appropriate conditions in order to eliminate the causes of illegal migration and eliminate its demand. The importance of joint efforts to develop and determine the main provisions of the migration policy of individual states and bodies of the international community in the fight against the organization of illegal migration is emphasized and comprehensively analyzed. The study of both international and the experience of various countries provides grounds for its use in Russian legislation on illegal migration.
