About some legal issues of social partnership in public service

Introduction: In this article is explored some issues of social partnership as a social phenomenon, such as coordination of interests of employees and employers. Argues that social partnership is a set of legal, political, economic, social and cultural phenomena, aimed at harmonizing interests of subjects of public authorities in the person of the state and local authorities, owners of the means of production and of representatives of wage labour for smoothing of social contradictions and sustainable social development. Purpose: It is revealing the specifics of the system of social partnership in public service, due to its public nature, related to the execution of powers of bodies of state power, the need for the existence of a relationship of subordination for effective operations. Methods: General methods of scientific research (dialectical, metaphysical); scientific research methods (analysis, synthesis, system, method); other methods (historical, comparative, formally legal, sociological). Results: It is noted that the system of social partnership in public service has its specificity, due to its public nature, related to execution of powers of bodies of state power, the need for the existence of a relationship of subordination for effective operations. Thus, a public nature of public service means of the fact that through it implements public, first of all, the state power. The basic international and national legal acts that defining the possible existence of social relationships and partnerships in the public service are called. Conclusions: The conclusion is made about the necessity of a special section in the Labour code of the Russian Federation for regulating the activities of trade unions in the public service, and the Federal law on social partnership in Russia, where the rules on the different types of responsibility of the social partners will be concentrated in single legal source, also it is most clearly and differentially determine the forms of social partnership, through which the coordination between civil servants and representatives of employers.
