About the need to improve the provisions on the types of permitted use of the land plot

The article analyzes the resolution of the Constitutional Court of the Russian Federation dated 16.10.2020 No. 42-P. In particular, the arguments of the parties to the dispute are examined in detail, the principle of legal certainty is investigated. The author analyzes the concepts proposed by the plenipotentiary representative of the President and plenipotentiary representatives of the chambers of the Federal Assembly. Highlights the merits and demerits of each approach. Concludes that the legislation on the types of permitted use should be improved by making changes to land, town planning legislation, as well as to the legislation on real estate registration.
