This article presents a study of the problem associated with an unjustified refusal to satisfy a request for questioning a witness at a court session. The normative legal acts, as well as materials of judicial practice, where the court considered it possible to refuse to accept witness testimony by virtue of a direct instruction of the law or on other grounds, are studied. The solution of the raised question is proposed.
